Abstract
Power remains a foundational concept in political philosophy, sociology, and public law; yet the emergence of algorithmic governance is challenging conventional understandings of how power is exercised, attributed, and legitimated. This study examines how the transition from centralized and visible forms of institutional domination toward data-driven and networked modes of governance is reshaping the relationship among power, authority, responsibility, and legal legitimacy. Drawing on a descriptive-analytical and documentary methodology, and critically engaging with the theoretical contributions of Max Weber, Michel Foucault, Pierre Bourdieu, Jürgen Habermas, Anthony Giddens, and Joseph Nye, the study argues that digitalization has not displaced power but reconfigured its modalities, rendering its operation increasingly dispersed, opaque, and technologically mediated. Algorithmic power is therefore conceptualized not as a substitute for political or institutional power, but as an emergent modality through which power is exercised, reproduced, and potentially obscured. The analysis distinguishes power as the capacity to shape outcomes, authority as socially and normatively recognized legitimacy, and domination as the institutionalization of asymmetrical relations. Within this configuration, law performs a dual function: it both institutionalizes power and constrains its exercise through the rule of law, transparency, accountability, effective oversight, contestability, and the protection of human agency. The study consequently situates algorithmic governance within a broader transformation of the legal and normative architecture of power in the digital age.
